Ventures LLC, a California limited liability company doing business as Aven Studio ("Aven Studio", "we", "us", or "our"), operates avenstudio.co and its related pages, features, and services (the "Services"), which provide a curated shopping experience for customers in the United States. The Services are powered by Shopify. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase through the Services, or otherwise communicate with us.

This Privacy Policy is a standalone document and is not subordinate to our Terms of Service. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information. By using the Services, you acknowledge that you have read this Privacy Policy.

SUMMARY. We collect the information needed to process your orders, support you, and, with your permission, send you marketing. We use Shopify, payment providers, Klaviyo, Gorgias, and our logistics provider to run the store. We do not store your full payment card number, and we do not sell personal information for money. You can opt out of sharing for targeted advertising, unsubscribe from emails, and reply STOP to text messages. Contact us at support@avenstudio.co.

1. Personal Information We Collect

"Personal information" means information that identifies or can reasonably be linked to you or another person. It does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, where you live, and as permitted or required by law, we may collect or process the following categories of personal information, including inferences drawn from it:

  • Contact details: your name, billing and shipping addresses, phone number, and email address.

  • Payment information: payments are processed by Shopify and other payment providers, including Shop Pay, Apple Pay, Google Pay, and card networks. We receive limited details, such as the card type, the last four digits, transaction details, and payment confirmation. We do not store your full card number.

  • Account information: your login credentials, preferences, and settings.

  • Transaction information: the items you view, add to your cart or wishlist, purchase, return, or cancel, and your past transactions.

  • Communications with us: the information you include when you contact us, including through email or our customer support platform, and our replies.

  • Marketing and messaging data: your email and text subscription status, consent records, phone number, and your engagement with our messages.

  • Reviews and content you submit: reviews, ratings, and photographs, which may show you or your pet, together with the name you use.

  • Program information: your participation in the Aven Pup Club and in referral, giveaway, loyalty, and points programs, and, if you refer a friend, the contact details you give us for that person.

  • Device information: your device, browser, network connection, IP address, other unique identifiers, and approximate location derived from your IP address.

  • Usage information: how and when you interact with or navigate the Services, including through cookies and similar technologies.

Some of this information, such as account login credentials and payment card details processed by our payment providers, is "sensitive personal information" under California law. We use it only to provide the Services and for security and fraud prevention, and not to infer characteristics about you.

2. Where We Get Personal Information

  • Directly from you, for example when you create an account, make a purchase, join a program, submit a review, or contact us.

  • Automatically through the Services, including from your device and through cookies and similar technologies.

  • From our service providers, when they collect or process personal information on our behalf.

  • From partners and other third parties, such as advertising and social media platforms when you interact with them or with our advertising.

3. How We Use Personal Information

Provide, tailor, and improve the Services. We use personal information to provide the Services, including to perform our contract with you, process payments, fulfill and ship orders, process returns and other transactions, create and manage your account, remember your preferences and the items you are interested in, send notifications about your account and orders, and recommend products related to your purchases.

Marketing and advertising. We use personal information to send marketing and promotional communications by email, text message, or postal mail, and to show you online advertisements on the Services or other websites, including based on items you have purchased or added to your cart and other activity on the Services.

Security and fraud prevention. We use personal information to authenticate your account, provide a secure payment and shopping experience, detect and investigate fraudulent, illegal, unsafe, or malicious activity, and protect public safety and our Services. If you register an account, you are responsible for keeping your credentials safe, and we recommend that you do not share them with anyone.

Communicating with you. We use personal information to provide customer support, respond to you, and maintain our relationship with you.

Reviews and programs. We use personal information to display your reviews and content on the Services and, as described in our Terms of Service, on social media and in marketing materials, and to administer the Aven Pup Club and our referral, giveaway, loyalty, and points programs.

Legal reasons. We use personal information to comply with applicable law and valid legal process, including requests from law enforcement or government agencies, to take part in litigation or other legal proceedings, and to enforce our terms and policies.

4. How We Disclose Personal Information

We may disclose personal information to third parties for legitimate purposes, including:

  • Service providers that perform services on our behalf, including Shopify; payment providers and digital wallets; Klaviyo, for email and text marketing; Gorgias, for customer support; our third-party logistics provider and shipping carriers; and providers of IT management, analytics, review management, and cloud storage.

  • Business and marketing partners that provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. These partners use your information under their own privacy notices. You may have a right to direct us not to share information about you for targeted advertising (see Section 10).

  • Third parties at your direction, when you ask us or consent to a disclosure, for example to ship your products or through social media widgets or login integrations.

  • The public, where you post a review or other content that is displayed on the Services or on social media.

  • Others as required or permitted by law, in connection with a business transaction such as a merger or bankruptcy, to comply with legal obligations such as subpoenas and search warrants, to enforce our terms and policies, and to protect or defend the Services, our rights, and the rights of our users or others.

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services is transmitted to and shared with Shopify and with third parties that may be located in countries other than where you live. To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate information from your interactions with our store, with other merchants, and with Shopify. In these cases, Shopify is responsible for processing your personal information, including for responding to your requests to exercise your rights over that use. To learn more about how Shopify uses your personal information and the rights you may have, visit https://privacy.shopify.com/en.

6. Cookies and Tracking Technologies

We and our partners use cookies, pixels, and similar technologies to operate the Services, remember your cart and preferences, understand how the Services are used, and, where applicable, show advertising. Third parties, including Shopify and advertising and analytics partners, may collect information about your online activity over time and across different websites. You can control cookies through your browser settings, and you can use the opt-out choices in Section 10. If you visit our website with the Global Privacy Control signal enabled, we treat it as described in Section 10. We do not recognize other "Do Not Track" signals sent by your browser or device.

7. Third-Party Websites and Links

The Services may link to websites or platforms operated by third parties. If you follow a link to a site we do not control, review its privacy and security policies and terms. We do not guarantee and are not responsible for the privacy or security of those sites or for the accuracy or reliability of their content. Information you share on public or semi-public venues, including third-party social networking platforms, may be viewable by others without limit on its use by us or by a third party. Including a link does not by itself imply endorsement.

8. Children

The Services are for adults aged 18 or over and are not intended for children. We do not knowingly collect personal information from anyone under 18, and we do not knowingly sell or share personal information of anyone under 18. If you are a parent or guardian and believe a child has given us personal information, contact us using the details in Section 15 and we will delete it.

9. Security and Retention

No security measures are perfect or impenetrable, and we cannot guarantee perfect security. Information you send to us may not be secure in transit, so please do not use unsecure channels to send sensitive or confidential information.

How long we keep your personal information depends on factors such as whether we need it to maintain your account, provide the Services, comply with legal obligations (for example, tax and accounting records), resolve disputes, or enforce our agreements and policies.

We use your phone number and related marketing data to send you the email and text messages you have agreed to receive. We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with third parties, except with service providers and messaging platforms that help us send the messages.

10. Your Rights and Choices

Depending on where you live, you may have some or all of the following rights. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

  • Access or know: request access to the personal information we hold about you.

  • Delete: request that we delete personal information we maintain about you.

  • Correct: request that we correct inaccurate personal information.

  • Portability: receive a copy of your personal information and ask us to transfer it to a third party, in certain circumstances.

  • Opt out of sale, sharing, and targeted advertising: direct us not to sell or share your personal information, or to process it for targeted advertising. You can do this by emailing support@avenstudio.co with the subject "Opt-Out", or through the Shopify privacy portal at https://privacy.shopify.com/en. If you visit our website with the Global Privacy Control signal enabled, we treat it as a request to opt out for the device and browser you use. If we can associate that device with a Shopify account, we apply the opt-out to the account as well.

  • Limit use of sensitive personal information: we use sensitive personal information only for the purposes described in Section 1, so no separate limit is needed.

  • Manage communications: you can unsubscribe from promotional emails using the link in any email, and stop text messages by replying STOP (see Section 13). If you opt out, we may still send non-promotional messages about your account and orders.

How to make a request. Email support@avenstudio.co with the subject "Privacy Request", or, for data that Shopify controls, use https://privacy.shopify.com/en. We may need to verify your identity before we process a request. You may designate an authorized agent, and we may require proof of their authority and verify your identity directly with you. We will not discriminate against you for exercising your rights.
